The Drain Code, a state law, establishes that the County Drain Commissioner oversees operation, maintenance and improvement of established county drains. In Wayne County, the duties of the Drain Commissioner are the responsibility of Kurt L. Heise, the Director of the Wayne County Department of Environment.

Due to ongoing flooding problems within the drainage district a petition was filed with the Drain Commissioner‘s office for the maintenance and improvement of the Drain. As a result a Board of Determination hearing was convened and a project was found necessary to address the problems.
